General Terms and Conditions

By ordering our products, the Buyer accepts the following delivery and payment conditions.

1 Legal basis

The conditions of German sales law shall apply pursuant to Sections 433 ff of the German Civil Code (BGB) subject to the provisos below.

2 Delivery/ shipping costs

We shall send in-stock items as quickly as possible, i.e. within 2–5 days after receipt of payment (see Pt. 8, Payment). From then on, the delivery time shall depend upon the standard time taken by the German postal service (Post AG). If the item needs to be made, we shall contact you about the delivery time. For shipping within Germany, we charge EUR 15.00. For delivery to all other countries, we charge the current prices for packaging and freight/carrier charges, depending on time required and weight. The delivery time for Buyers outside Europe can be several weeks.

3 Prices

On request, we will provide you with special offers, as well as prices for individual pieces or for several pieces combined as gift arrangements. The prices stated by the Seller are binding and include the statutory VAT which applies in each case. Customers from abroad please note that all prices and tax rates apply for Germany. Customs duties, import taxes and/or other fees will have to be paid instead of value-added tax, depending on the destination. All these fees, in the wider sense of the word, shall be paid additionally by the customer. They shall not be advanced by OVOFACTUM®.

4 Reservation of title

OVOFACTUM® shall retain legal title of the goods until payment in full.

5 Right of return

We hope you will be satisfied with the products you order from OVOFACTUM® and take pleasure in them. Of course, on some occasions this may not be the case. The Buyer has a 14-day right to return the goods without needing to name any reason for doing so. This period starts on the day the goods are delivered to the Buyer, according to the delivery note. The date the item returned is received by the Seller shall determine the length of time which has elapsed. Items shall be returned by the Buyer at the Buyer’s own risk. In case of special orders (e.g. custom-made items), there shall be no right of return or exchange.

6 Reporting defects and guarantee

Obvious defects in the goods are always to be reported in writing to the Seller by the Buyer within one week after the goods are delivered. The same applies to any defects discovered or incomplete deliveries, in so far as these are not a case of "partial performance” (pre-arranged delivery in stages). Nonobvious defects to the goods shall be reported to the Seller in writing immediately after they are recognised or discovered. The Buyer’s overall warranty claims are limited to the right to rectification and/or replacement. If the rectification or replacement fails, the Buyer shall be entitled to reduce the payment or cancel the contract. In the cases described above, the Buyer is to return the goods to the Seller immediately. The Seller shall reserve the right to check the defect reported; if the defect reported is legitimate, the Seller shall reimburse the Buyer for the shipping costs.

7 Data protection

Without your express agreement, we shall ascertain, save and use your data only for processing your order. To allow us to carry out and deliver your order, we shall only pass on your data to the delivery service commissioned with the delivery in each case. Please let us know in writing if you wish your personal data to be deleted, frozen or changed.

8 Payments

Payments shall be carried out in advance. To pay in this manner, please transfer the sum shown in the bill to our account. Once payment is received, the order will be packaged and sent.

9 Severability clause/ other

If any part of these terms and conditions should be ineffective for any reason, this shall not affect the validity of the remaining provisions. Prices subject to change. Errors and omissions excepted. We can accept no liability for typing, printing or transcription errors. The place of jurisdiction shall be Dresden.
